Business Customers

Powder FX supplies products primarily to business customers.

By placing an order with us, you confirm that you are purchasing in the course of business and have the authority to enter into a legally binding contract on behalf of that business.

We reserve the right to refuse, cancel, or limit any order at our discretion.

Acceptance of Orders

All orders are subject to acceptance by Industrial Powder & Paint Services Limited.

An order acknowledgement or confirmation does not constitute acceptance of an order.

A contract is formed only when goods are despatched or otherwise supplied by us.

We reserve the right to refuse any order for any reason, including pricing errors, stock availability issues, regulatory requirements, or suspected fraudulent activity.

Pricing

All prices displayed on our website are exclusive of VAT unless otherwise stated.

Prices, product specifications, and product availability may be amended without notice.

The applicable price shall be the price in force at the time the order is accepted.

Where a pricing error has occurred, we reserve the right to cancel the order and refund any payment received.

Payment

Payment shall be made in accordance with the agreed payment terms.

Where credit facilities have been granted, invoices must be paid by the due date stated on the invoice.

Failure to make payment when due may result in:

Suspension of further deliveries
Withdrawal of credit facilities
Recovery of debt collection costs
Interest on overdue amounts where permitted by law

The customer shall indemnify Industrial Powder & Paint Services Limited against any reasonable costs incurred in recovering overdue debts.

Retention of Title

Ownership of all goods supplied by Industrial Powder & Paint Services Limited shall remain with Industrial Powder & Paint Services Limited until full payment has been received for:

The goods supplied; and
Any other sums owed by the customer to Industrial Powder & Paint Services Limited.

Until ownership passes:

The customer shall store the goods separately and clearly identify them as the property of Industrial Powder & Paint Services Limited.
The customer shall keep the goods insured and protected from damage.
Industrial Powder & Paint Services Limited reserves the right to recover the goods if payment is overdue.
The customer grants Industrial Powder & Paint Services Limited, its employees and agents the right to enter any premises where the goods are stored for the purpose of recovering them.

Risk in the goods shall pass to the customer upon delivery.

Product Information

Technical information, product descriptions, colour representations, application guidance, curing schedules and other product data are provided in good faith and are believed to be accurate at the time of publication.

Customers remain responsible for determining the suitability of any product for their intended application and should conduct their own testing before commercial use.

Due to differences in application methods, substrates, curing conditions, lighting conditions, photography, printing and screen settings, colours shown on this website, in brochures, videos, social media content or marketing materials should be regarded as a guide only and may differ from the finished product.

Published technical information may be updated without notice as products are developed and improved.

Compliance and Product Use

The customer is responsible for ensuring that products are used, stored, transported and disposed of in accordance with all applicable laws, regulations and health and safety requirements.

Safety Data Sheets and technical information should be reviewed before use.

Industrial Powder & Paint Services Limited accepts no liability for damage or loss resulting from misuse, incorrect application, incorrect storage, contamination, or failure to follow product instructions.

Intellectual Property

All content on this website, including text, graphics, photographs, product descriptions, logos, downloadable documents and marketing materials, is the property of Industrial Powder & Paint Services Limited unless otherwise stated.

No content may be copied, reproduced, modified, distributed or used without prior written permission.

Unauthorised use of the Powder FX® name, branding, product descriptions, photographs or intellectual property is strictly prohibited.

Delivery, Returns and Refunds

Delivery charges, delivery times, returns, refunds, damaged goods procedures and Northern Ireland shipping requirements are governed by our separate Returns & Delivery Policy.

By placing an order, you agree to the terms set out in our Returns & Delivery Policy.

Limitation of Liability

To the fullest extent permitted by law, Industrial Powder & Paint Services Limited shall not be liable for any indirect, consequential, incidental, special or economic loss arising from the supply, sale or use of its products.

Our total liability in respect of any claim arising from the supply of goods shall not exceed the purchase price of the goods giving rise to the claim.

Nothing in these Terms and Conditions shall exclude or limit liability for:

Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any liability that cannot legally be excluded under English law

Force Majeure

Industrial Powder & Paint Services Limited shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to:

Acts of God
Fire
Flood
Adverse weather conditions
Industrial disputes
Supply chain disruptions
Transport failures
Government action
War
Pandemic or epidemic events

Personal information supplied to us will be processed in accordance with our Privacy & Cookie Policy.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
